Holloway Denies Injunction To Prevent Brown Swearing-In Ceremony

Brown to be sworn in during 9:00 a.m. ceremony Wednesday

   Judge Robert Holloway denied the issuance of an injunction Tuesday that would have prevented Lawrence County Sheriff-elect Jimmy Brown from taking office Wednesday morning.         

   Sheriff Kenny Taylor had sought to keep the ceremony from taking place until such time as a ruling is made in his lawsuit, contesting the results of the sheriff’s race in the August 5, 2010 County General Election. Jimmy Brown was declared the winner drawing 3,516 votes.

Taylor drew a total of 3,398 votes; Mike Risner 2,497, Lee Adam England 332; and Pete Shrader 175. With a near 2,500 votes cast for Risner, many felt that Risner’s bid may have slanted the outcome of the election. Taylor alleged in his suit that Risner does not reside inside Lawrence County and was not eligible to run for the office in the first place.

   Attorney Russ Parkes filed the request for a temporary restraining order Monday on behalf of Taylor. The motion was heard by Chancery Court Judge Holloway Tuesday morning. Holloway then opted to deny the request.

   Brown is slated to be sworn in, as planned, during 9:00 a.m. ceremonies Wednesday, September 1 at the Lawrence County Courthouse.

   A hearing to consider Taylor’s lawsuit will be held sometime before October 1.
