Domestic Assault Charges Brought As Result Of Cell Phone Recording

   A cellular telephone recording was the key that landed a Lawrenceburg man behind bars Saturday on domestic assault charges.

   According to reports filed through the Lawrenceburg Police Department, officers were dispatched in regards to a domestic altercation shortly before 10:30 p.m. When they arrived at the North Mahr Avenue residence, they report the couple in question was sitting on the front porch, smoking cigarettes.

   Officers noted that the victim, age 43, had sustained a cut beside her left eye, and that she had bruising along the right side of her chin. When they asked her about the injuries, she told officers she “fell down.” Shortly, they report she changed her story, stating that she had suffered a seizure the previous night. In addition, she told officers that her boyfriend had struck her with a spatula while they were cooking. She pointed out that he “didn’t mean to.”

   While officers were speaking with the subjects, they report that an eighteen-year-old woman pulled up, stating that she had heard the couple’s fight via her cell phone. She told officers that the man had been cursing and yelling at the victim, and that she had recorded the event on her cell phone.

   The officer listened to the entire recording, making a copy to enter into evidence. He then placed the suspect, Michael Phillip Rose, 42, of 917 Mahr Avenue, under arrest on one count of domestic assault.

   Rose is scheduled for an initial appearance in Lawrence County General Sessions Court on June 6, 2008.
