Public Hearing Scheduled For Proposed Zoning Change

   City of Lawrenceburg leaders have scheduled a public hearing regarding a proposed zoning change for property located at the Weakley Creek/Springer Road intersection.

   Members of the Lawrenceburg Board of Mayor and Council voted to approve the zoning change on first reading during their meeting Thursday morning. The ordinance was brought before the council under a negative recommendation by the city’s planning commission.

   The ordinance calls for property owned by Larry and Linda Braswell, located at the intersection’s northeast corner, be rezoned from the current R-2 (low-density residential district) rating to C-4 (neighborhood convenience service district).

Paperwork submitted by Cleghorn Land Surveying, LLC, indicates that the land would be utilized for construction of medical and professional services offices.

   When presenting the ordinance City Attorney Alan Betz pointed out that the change would be classified as “spot zoning,” a practice that is illegal. Betz confirmed, however, that there are some exceptions.

   During a discussion council members questioned whether a zoning change for the property would be prudent.

Should the property be sold after the zoning change, but prior to the construction members said, “It would open the property up for use of anything allowed under a C-4 rating.”

They questioned whether a zoning change could be made with a stipulation that, should the land not be used for the specified use, it revert to the R-2 rating.

   Betz pointed out that because the ordinance was submitted under a negative recommendation from the planning commission, it would require a minimum of three positive votes for passage.

No negative votes were cast. Betz stated his intention to further research the matter in order to answer questions during the upcoming public hearing and second reading.

   The public hearing will be held during the council’s Thursday, October 24th business meeting which gets underway at 8:30 a.m. Members will then consider passage on second and final reading.
