Council Removes Residency Requirement To Sell Liquor

Lawrenceburg leaders have voted to eliminate a section of the city’s ordinance governing the sale of alcoholic beverages that stipulates that the license holder reside locally.

During their business meeting Thursday morning, members of the Lawrenceburg Board of Mayor and Council approved an amendment to the city’s ordinance regarding the sale of alcoholic beverages other than beer.

Section 8-206 of the ordinance, titled “Residency Requirement,” stipulated that all individuals holding a certificate of compliance for the sale of liquor, be Lawrence County residents. The requirement was incorporated when the ordinance was originally adopted in June of 2007.

Mayor Keith Durham pointed out that the stipulation has incidentally served to restrict persons to whom local business owners may sell their businesses.

He pointed out that, since the council has no authority to regulate the sale of any other type of business, neither should it hold that authority over individuals who possess a liquor sales license.

Council members voted Thursday to delete the residency requirement section in its entirety. The ordinance became effective immediately upon its passage.
