Lawsuit Filed Against Delinquent Solid Waste Accounts
Suit is Follow-up to Aggressive Collection Efforts

A lawsuit has been filed in the Circuit Court of Lawrence County against over 3,800 holders of delinquent residential and commercial solid waste accounts from the past 8 years.   

According to the suit filed this week, a combined outstanding balance of more than $460,000 will be sought for solid waste accounts dating back to 2001.

According to County Attorney Charles Holt, a copy of the lawsuit and a waiver of service of summons were mailed to the delinquent parties on July 27.  

By signing the enclosed waiver and returning it within the required time, defendants will avoid the process of being formally served with the paperwork and the additional associated costs. 

In cases where the waiver is not returned, service of summons by the sheriff’s department or private service will be made at the defendant’s home or place of business with all costs associated with service to be added to the court case.

The lawsuit is a follow-up action to an aggressive collection effort which began two years ago. Since that time, approximately $350,000 in previously unpaid solid waste disposal fees has been collected.

 According to Holt, the cases involved in the lawsuit represent only a small fraction of the county’s solid waste disposal fee accounts.  “The issue at hand is of fundamental fairness and equity under the law,” Holt said. “It is unfair for some to pay their solid waste disposal fee and others to not.”
