Commission Re-establishes Distance Requirement For Beer Ordinance

   Members of the Lawrence County Board of Commissioners have voted to re-incorporate a distance requirement into the county’s beer ordinance.

   Members of the commission met in regular session Tuesday afternoon. During the meeting commissioners were asked to approve a resolution to, “Amend the Lawrence County Beer Ordinance to provide that no permit will be issued authorizing the sale of beer within 1,000 feet of any school, church or other place of public gathering.”

   During recent litigation involving the issuance of beer permits commissioners learned that the 2,000 foot distance requirement formerly included in the ordinance had inadvertently been voided.

The Tennessee Attorney General’s office determined that the rule had been nullified in 2001 when a license was issued to a business that was not in compliance with the distance requirement.

   Passage of the amendment brings the county’s beer ordinance back into compliance with state statutes.
