EEOC Files Suit Against Bertolini Corporation

   The U.S. Equal Employment Opportunity Commission (EEOC) has filed suit against Bertolini Corporation in regards to the recent firing of two employees who lodged complaints about racial discrimination.

   The suit was filed in U.S. District Court on Thursday. The EEOC, an agency tasked with enforcing federal laws prohibiting employment discrimination, asserts that the terminations violated Title VII of the Civil Rights Act of 1964.

The act protects employees against retaliation for complaining about discriminatory practices. EEOC officials report that the suit was filed after attempts to reach a voluntary settlement with the company failed.

   According to a press release issued by the EEOC, the matter involves actions taken against Bertolini employees Brian McBride and Cindra Newton. Both reported that Hispanic employees were being treated more favorably than non-Hispanic employees.

   McBride had reportedly lodged a complaint with the plant’s human resources department as well as to Plant Manager Gary Daniels. Shortly thereafter, he was disciplined, then fired.

   Newton, who was employed in a human resources capacity, lodged a complaint with Daniels as well as the corporate human resources department. She, too, was terminated shortly thereafter.

   Of the case EEOC Memphis District Director Katharine W. Kores stated, “Federal law and Supreme Court precedent provide that all employees have a right to complain about practices they reasonably believe are unlawful without repercussions, and the EEOC will continue to act forcefully to protect this right.”
