Parents File Suit In Drowning Death

  Attorneys for the parents of a six year old who drown recently at Rotary Park Swimming Pool filed a lawsuit through Lawrence County Circuit Court Friday morning naming as defendants both the City of Lawrenceburg and Lawrenceburg Rotary Club.

  Samuel Clay Dupree Lavka was found floating face down in the pool on July 1. He had been participating in a swimming activity while attending Day Camp through the Lawrenceburg Parks and Recreation Department. Efforts were made to revive Lavka. He was transported to Crockett Hospital, then on to Vanderbilt University Medical Center in Nashville, where he died two days later.

  In the lawsuit, parents Samantha Dupree and Terry Lavka allege that those on duty failed to comply with operational plans, policies and procedures that “would have prevented” Lavka’s injury or death; that training and supervision of lifeguards was inadequate; and that the Lawrenceburg Rotary Club “conducted, managed, supervised, controlled, in whole or in part, the Summer Day Camp and its various activities.”

  A total of $11,000,000 in damages is sought; $5 million each for mother Samantha Dupree and father Terry Lavka for wrongful death, funeral expenses, and monetary damages, and $1 million in general damages, as well any other such relief the court “may deem appropriate.”
