Vacant Commission seat will be filled May 24
There has been much speculation about how and when the 15th District Commission seat vacated with the resignation of Jeffrey Hughes will be filled.
Three candidates remain for voters to choose from August 4: Aaron Pope, Tammy Wisdom, and Karen Woodall. But since that election is beyond the 120 day limit for vacancies on the Commission, someone will be named to fill the seat temporarily.
Tennessee Code Annotated 5-1-104 states that “Vacancies in county offices required by the Constitution of Tennessee or by any statutory provision to be filled by the people shall be filled by the county legislative body, and any person so appointed shall serve until a successor is elected at the next general election . . . .
“The county legislative body shall be required to make an appointment to fill a vacancy within one hundred twenty (120) days of receiving notice of the vacancy . . . .”
Commissioners and I are in agreement that the person we appoint should not be one of the three running for the office. We don’t want to give any candidate what would amount to an endorsement, and therefore an unfair advantage – or disadvantage – in the August election.
Whoever is elected by the Commission at their May 24 meeting will represent the 15th district at a special called meeting in June, when we expect to approve our 2016-17 budget; and at the regular session in July.
Nominations to fill the empty seat from May 24 to August 4 may be submitted to my office. Commissioners will then nominate candidates from that pool of names. A majority vote, at least nine of 17, is required for the appointment.
