Retirement Credit Granted City Employees Who Served In Persian Gulf War

   Lawrenceburg leaders have voted to grant retirement credit to all city employees who served in the Persian Gulf War.

   The resolution was brought up for consideration during the bi-monthly business meeting of the Lawrenceburg Board of Mayor and Council Thursday morning.

   The resolution was “to authorize retirement credit for military service rendered in the armed forces of the United States during the Persian Gulf War in accordance with …Tennessee Code Annotated, through the Tennessee Consolidated Retirement System (TCRS).”

   Tennessee Code Annotated provides that, “any member who leaves or left services with the State of Tennessee or any political subdivision (TCRS participating members such as the City of Lawrenceburg)…in order to perform military duty in the armed forces of the United States during the Persian Gulf War, and who is reemployed by the State of Tennessee or a participating political subdivision within six months after being relieved of such military duty shall have the option to establish retirement credit for such military service without charge to the member.”

   The resolution identifies the Persian Gulf War as beginning August 2, 1990 and running “to the date thereafter prescribed by presidential proclamation or by federal law.”

   Under TCRS guidelines credit for military service may only be granted:  1. If the credit cannot be established under any other retirement system. 2. If the member was honorably discharged. 3. On the condition that the individual becomes vested in his job.

The guidelines also indicate, “In no case shall retirement credit granted for such military services combined with any other military service credit granted exceed an aggregate of four years.”

   City of Lawrenceburg Attorney Alan Betz explained to council members, “If you qualify under TCRS you get that military service credit toward retirement…whether you worked for the city at that time or not.”

   City Administrator William McLain pointed out that such retirement credit must be approved in the wake of each military action. He also indicated that the resolution will affect several city employees.
